fruit tree id?

I have seen a few of these trees around town and I can't figure out what they are and have been trying to find out for quite awhile. Its not an autograph tree, the fruit is different but there is some similarities.

There is no indication of scale in the picture but compare with Pittosporum tobira - not an edible fruit tree.

Not a Pittosporum, in the picture I am standing under the tree looking up into it for the photo. The tree is about 12 feet tall
