plant identification

I noticed this plant in a mixed border on Toronto centre island. Can anyone please tell me what plant this is (annual, shrub, perennial) and how it looks through the season? I saw it in August. Thanks.

Did it happen to have tiny little peppers on it? It looks like the ornamental pepper I used to grow.

looks like it may be 'Black Pearl' ornamental pepper. the seedlings are deep purple like the mature plant. fruit starts off deep purple and turns bright red when ripe, though very little viable seed is set.
