He's name is Kevin, 587-784-0047 from Edmonton

| Unless you copywrited the pictures I don't think you have any legal rights. When you put things on the web without saying they are not for publication to any other site they may be grabbed by others. What I would do is call the fellow and tell him you don't like him using your photos and if he doesn't remove them you will publish on other blogs and sites that he is misrepresenting what he has for sale by using photo's of your trees. I think that's about all that you can do about it. Of course someone may know more than I do about these things, so don't take mine as the last word |

| All photos have an implicit copyright - actually, any content you generate is automatically "copyrighted". Email Kijiji about the ad and ask them to remove the pictures. |

| I guess he came across your photo and thought it was okay for his own use, but should instead have photographed his own that he has for sale. I'm sure no bad intention was meant, though it's a surprise to see our photos having been used or "taken" by someone else ... as long as he does not now come and dig your trees Konrad :) Terry |

I thought I saw a place on the site that you could post a question to him. Why don't you on that site ask him where he got the pictures and ask if they are his. Then you know if he is truthful or not and you can post right there that they are yours and that you don't appreciate him using the pics without asking for permission. Kathy |

| Thank you all! I have notified Kijiji before I posted here but have no reply yet. As you said, taking pictures out of websites and using it for your gain and profit is not acceptable, people like this to my eye are pretty low class in our society. This is fraud and misleading he's customers. I don't mind giving out pictures ....have done several time's but they have asked first and when published I get credited. In no way someone should profit on your pictures. Kathy, yes I can ask him on the site but better yet I thought I will call him and ask directly, sure love to go out and look at these trees..LOL. Who knows, maybe he has no trees himself...are some nurseries missing any????? Oh by the way..I found other ads somewhere, he also is picking up unwanted vehicles. I'll wait a couple of day's. So sorry to hear of this happening to you Konrad.I wonder why he had to use your pic. Could your not go on site and tell people the photo is a misrepresenation The nerve of some people. Let's hope he's not a gardener as I hate to think of one being so dishonest. Watch out for your trees as you may find a midnight raider Lois |

| This is why I don't post good pics at GW anymore. When iVillage took over this site, they changed the "Terms of Service" ( in particular section7), and explicitly say that any pics or pros posted here are theirs to do with as they please, which includes selling said postings. All postings here are still yours, but you now have shared rights to them with iVillage. Really, this isn't too much different than what was previously said in a more round-about and obscure way, with GW's previous owner. It just went a little bit farther, and blatantly states it without any ambiguity. That's why so many people left GW several years ago. The Far North forum is one of the few that were not affected much. You can read the terms of service by clicking on it at the bottom of any page. I frequent another garden forum site far more regularly now (where photos are are individually copyrighted), but the change here at GW hasn't scared me away, just made me a bit more cautious. BTW, technically, they could sell your email address too, although I don't think they have yet, and couldn't say if they ever intend too; but it is a legal option for them. I encourage everyone to use a disposable email address on your GW member page, just in case. Back to the case at hand, Konrad, I haven't heard of iVillage selling anything posted on these forums, and I sincerely doubt they have (or will). But it would be legal if they decide to. If you still have the original photo(s) in question, that would be uncropped or unreduced in file size, or the film negative or photo, that is your best evidence of thievery. It cannot be disputed. If you contact this Kevin again, I would make this very clear. |
Actions regarding pictures

| In a way he has given you a complement: He's saying he likes your work. Since you likely aren't making a living at it you can live with it. OR Ask him to give you credit. E.g. At the bottom of the ad a line, "Photo by Konrad" OR In the future be sure that a copyright "Photo By Konrad" is lightly screened over the picture. This takes some effort to remove, and he will likely take some one elses. More general safeguards: 1. In addition to a text label on the pic itself, make sure you are listed as the photographer and copyright holder in the meta data inside the pic. Sure it can be removed, but it is one more step a thief has to take. And using it as a search term in Google Images will usually find the image. 2. Never publish a full sized image on the web. Always resize down somewhat or crop. In the event of an ownership dispute, having the full resolution uncropped image can be proof that the original was yours. 3. If you take 40 pix of something to get a decent one, keep a couple of the also rans. This is also proof that you were the original photographer. You can show a photo session including other pics. This lends credibility to your claim. |

Thank you all! Just phoned him today, when I asked if these trees are he's he said yes, when asked if I can see them he said, they are on he's Uncle property down by Red Deer but I can drive by your place and show you a tree. When I said that these trees are mine he was speechless,...told him to take off add in Kijiji, he said OK. About 5 min. later he called back and apologized, said he is new to internet da da da...still a chronic lier IMO. Have emailed Kijiji 3 times and nothing was done. Konrad |

| Way to go Konrad!. Glad to hear you told him even tho he tried to lie his way out of it.He may think twice before he tries a stunt like this again.But I am surprisec kijiji has not responded even if just to acknowledge your complaints. |
