Replacement tree for hosta garden?

The purple ornamental plum shading my hosta garden is dead from borer beetles. Hurricane Sandy tore off a few branches and then the beetles took over the kill. Pieces of the tree break off every few days. I want the management to take it down.

The word in our co-op complex is "we will not plant any more trees". I need a tree to shade that garden. The oak trees overhanging the garden from the curb strip are too high to really shade the hostas, thus the scorch I saw on Maui Buttercups and Blue Cadet.

So...if I can convince them to get rid of the dead tree, what type of similar small tree could I get to replace it? Of course, I would have to get the tree myself. Would a Japanese maple be under the column of "Dreaded Hosta-killing Maples"?
