Bay Tree ... can i dig up

i have a bay tree, about 3 ft tall, maybe four, that i want to dig up and put in a container ... is it still ok to do so?

Yes. During the dormant season is the best time to move things, usually, which would be Nov to Feb. In your zone 9, last frost date is about mid-March, so protect it if there is a frost/freeze. I would definitely not move it when it will be under the most stress, which in your zone would generally be June thru Sept, and particularly July/Aug. I would get as much of the root ball as you can. Use an appropriately sized container (large one). I have had success pruning/trimming the branches a bit when I make the move, so that there isn't too much foliage for the roots. I would not fertilize it right away, but I would keep it watered and probably out of strong sunlight for the first week or two. And you probably already know this but use a good potting soil, not garden soil in your container. They make potting soil with those water-retention crystals (sometimes referred to on the packaging as "moisture control") but that is not mandatory.
