should I trim this unleaved top?

I planted this japanese maple last year. It had leaves to the very top. So far this year, the top doesn't have any leaves. The tree has leafed out, the top has what looks like leaf buds, and when I scratch it, it's green, so it's not dried branches. It has been like this for about a month. Do I prune off those branches, when? Will I wreck the tree? Sorry I don't have a better picture.
