Japanese Maple Falling Down - How?

I have a small Japanese Maple that starting leaning far to the left. I went to it and disovered it is indeed falling down. The tree is still alive and looks vibrant, but the root structure is not supporting it. The tree was planted a year ago on mounded up soil and in a hole dug into my hillside's rocky, clay soil, so I initially thought we didn't dig the hole deep enough. We have moles on our property, but I don't see any evidence of them near the tree.

Any idea what's happening and can I tansplant the tree back into the same spot, and how? Thanks...
