Selling veggie plants in VA

Anyone know where I might find info on what I need to do to be legal while selling vegetable plants in Virginia? I sold a few tomato plants last year (less than $150 worth) and it went really well, so I decided to do the same this year and expand to sell some peppers and herbs. I called my local business license office and they had no idea how to help me or whether I fell under hobby or under nurseryman or under food seller rules, so they told me to figure out which I'd be and call them back (yeah, no help at all). If it's less than $500 is it just a hobby and therefore not in need of permits and such? I don't want to run afoul of the law, but I also don't want to loose $$ on a very small operation just to get the permits and such in place. Any help clarifying would be fabulous. Thanks.

check with your county extension office, they may be able to help. In Indiana, if you sell plants, which are taxable you need a "retail merchants certificate".
