Live plant vs. Fresh Cut

Are the laws governing selling a potted herb as a bedding plant different than selling the same herb cut and bagged as a food item? I can't find anything online. I'm in North Carolina.

I sell bedding plants at a local flea market. I am selling a lot of herbs, mainly to Hispanics. Some of them express that they have no itention to plant the herbs, they are just going to keep it alive on the porch and harvest leaves throughout the week and return next weekend for a new plant. Looks like a goldmine to me. But I wonder if the federales feel differently when I cut the herbs and package them for sale as food?

i think this is a state/local law thing.
you could try calling your local food safety/consumer protection official.

Yes, state laws cover this. In MD, the distinction is that dried herbs are "processed" (and you need a certified kitchen) but fresh cut herbs are not regulated, like herb plants.

Live plants are ususally regulated by state Ag & Markets law. This is because living plants are purchased and brought to where they come in contact with other plants. States are interested in containing potentially dangerous insects & plant diseases, and they best do this by inspecting production & storage facilities.
