Looks to be some kind of oak. A double trunk is a structural defect that the original purchaser should have noticed and walked away from in the nursery lot. I love trees and oaks are particularly nice, but I would be tempted to sacrifice this one to the chainsaw. Give yourself some sunlight or the place to replant a nicer specimen.

However, if you decide to do some pruning first - wait until winter when the tree is fully dormant. Cutting and pruning in the spring releases sap from the cuts which attracts beetles which can cause oak-wilt disease.

Cut any brances that are growing into eachother and rubbing as well as any dead wood. Must be planted deep if you can't see the base of both trunks. If you're really daring and feel like rolling the dice, make a quality choice between the two trunks and cut one out and see what happens.

I had the smaller half of the tree cut down which left the healthier with a big naked side. I was shocked that it only took a few days before the branches to start reaching for the new light they could receive.

Unfortunately all the new sunshine had me realize that this particular tree was out of place and quickly outgrowing my backyard. I had the other side cut down, which opened up a new sunny location for a garden and gave my lawn the sunshine it needed to fight off all the creeping charlie I was dealing with on account of it.

It really saddened me to see it go, but in the long run I think this was best for my property.
