Patented Pomegrantes?

My next door neighbor has 3 types of pomegranates I have been drooling over.
Ambrosia
Sweet
Wonderful
He has offered to take cuttings so I can root them and have my own. The only problem is, are these three patented plants, or public domain. He was not sure when he bought them if they had tags on them. It was too long ago.
Anyone have a clue?
I don't want to get into the legalities of it.
If they're patented, I'm not taking them. It's just that simple.
