Yes, it is true that different plants are considered invasive in different states. I don't quite know how to deal with that from the trader angle - as a trade receiver, I try to make myself knowledgeable about what is invasive here and either not trade for it/accept it (e.g., purple loosestrife) or contain it if I can. I have mints, artemisias, and goldenrod - all invasives - in my gardens, and try to keep them contained to their areas and keep an eye on deadheading them.

As far as legality across state lines and all, I BELIEVE (but am not entirely in the know - disclaimer here) that private transactions aren't regulated. I know in MA they are talking about prohibiting SALES of several species considered invasive, but to the best of my knowlege, it's still ok for me to dig up a plant and give it to a friend.

I have salvia coccinea rampant in my yard, so I would never want to trade for it. But my friend in Georgia actually PLANTS it in her yard, says it is a 'wimp' there.

I think you just have to know what is invasive in your area, but you should not have to be responsible for what goes on in other parts of the country. You can always note that certain seeds are 'invasive in my part of Texas', and leave it to the wantee-make that the wanter- to decide whether they want it or not.

Depends on how the law is written but don't know of any where it is expressly forbidden to trade state listed species.
The laws are more geared to selling and cultivating the species in question..
Morning glories are indeed considered invasive by a few states and are on the Arizona state seed list if I remember correctly.
I personally would not send anyone a species that was on their states official state weed list no matter how bad they wanted it!!
