What is this fly???

Hi everyone,
I'm new to square foot gardening and was wondering if you all can identify this fly for me..its smaller than a house fly and i have a ton of them flying over my raised bed all day. They lay these tiny brown eggs on the stems of the plants. I hope they're not going to cause me any problems. I've been blasting the eggs off with a hose every time I see them.
here's a picture of the fly on a leaf of my apple tree, and the eggs on the stem of a tomatillo. Thanks in advance!

Unable to see sufficient detail to ID it.
Is it damaging anything?
