Cherry tomato seedling?

I'm not sure if this is my cherry tomato plant or a weed. The popscicle stick I was using as a id was pulled up by the stray cat (I usually set out food for it by the small garden bed)

It does look a bit like some potato-leaf variety seedling. Some resemblance with a pepper seedling too.

That does look like a pepper plant.

I just filled a 4" pot with spoil and transplanted the plant there. We'll see what happens. ;P
