Coconut cream is not patented.
None of Zill's released mangos are patented as of now. I think he has either applied for or planning to patent the OS. Not sure anymore though.

There is no set method regarding how you would license a plant that is patented. That is up to the patent holder to decide if they will be the exclusive seller of the trees or license you to graft it yourself.

For a list of current and past patented mango varieties search the US patent office records for mangos. There are a few.

If I recall, the way patents for plants work is that, normally, any sale of the plant (I would imagine cuttings too) require payment to the rights holder. So if you bought the plants from some place, it's up to them to pay the fees. If you are making your own, you should pay the fees as well, you would actually need permission first, but if we're talking "personal use" then the odds of you getting caught are very slim.

I think there are also fees tied to the fruit sold in some cases, but it might be unrelated to patents.

Speaking of new releases and sort of straying off topic here, has anyone seen the original Lemon Zest, Coconut Cream & Harvest Moon trees? Exactly how vigorous are these trees? CC doesn't seem too bad but LZ seems like it's going to be a massive tree.

I had that same label on my tree when I got it earlier this year. Doesn't mean much if they haven't actually patented it. If it hasn't been patented yet it should say patent pending, not patented. If I remember correctly, they printed those labels without even applying for a patent. Not sure if they have applied for one as of yet. If they did, their patent attorney probably would have advised them of the correct labeling.

As for the TM symbol, that means it is an unregistered trademark and they would be limited as to who they could sue for trademark infringement.
