Settle an Argument: Weed or Plant?

My mom and her husband are debating the identity of this weed/plant. My mom thinks WEED, her husband thinks PLANT. She wants to get rid of it, he tells her to leave it alone.
PLEASE, can someone identify this THING for them before it takes over their garden like KUDZU??
